At ZESMACK, we take pride in offering high-quality handcrafted items such as MDF décor, acrylic art, wooden crafts, and natural polished diamonds. Our Terms & Conditions ensure a transparent, fair, and secure experience for all customers and partners.

1. Acceptance of Terms

By accessing or using zesmack, you acknowledge that:

  • You have read and understood these Terms

  • You agree to be legally bound by them

  • You are legally eligible to enter into a binding agreement

Eligibility

You must be at least 18 years old (or the legal age of majority in your region) to use our Services.

We may modify or replace these Terms at any time. Updated Terms will be posted on the website with a revised “Last Updated” date.

Your continued use of the Services after updates means you accept the revised Terms.

We do not endorse User Content or assume liability for it.

All content on ZESMACK text, graphics, images, videos, logos, product descriptions, and software is owned by us or our licensors and protected by copyright, trademark, and intellectual property laws.

You may not:

  • Copy, reproduce, modify, or sell any website content

  • Reverse-engineer or tamper with the website

  • Use our trademarks without written permission

 

6. Product Information & Availability

We strive to provide accurate product descriptions and images. However:

  • Colors may differ due to lighting or screen variations

  • Handmade items (MDF, acrylic, wooden crafts) may have slight natural variations

  • Diamonds may vary slightly within accepted tolerance grades

If a product is not as described, your remedy is to return it unused following our returns policy.

 

7. Pricing & Payment Terms

Pricing

  • Prices are shown in INR unless stated otherwise

  • Prices may change without notice

  • Taxes, duties, or shipping charges are added at checkout

Payment

We accept major payment methods (UPI, cards, wallets, net banking, etc.).

By placing an order, you agree to:

  • Provide accurate billing details

  • Authorize us to charge your selected payment method

If payment fails, we may cancel or hold the order.

 

8. Shipping Policy

Shipping times and fees depend on:

  • Destination

  • Weight

  • Courier availability

We typically process orders within 1–3 business days.
Delays due to weather, customs, courier issues, or peak seasons are beyond our control.

A tracking link will be provided once shipped.

Some locations or product types (heavy MDF items, valuable diamonds, fragile pieces) may have restrictions.

 

9. Returns & Cancellations

Please refer to our full Return, Refund, Replacement & Cancellation Policy for detailed rules.

Key points:

  • Items must be unused and in original packaging

  • Personalized/custom items and diamond products with tampered seals are non-returnable

  • International orders are non-returnable

  • Refunds issued to original payment method

Cancellations are allowed before shipment.
Once shipped, the order cannot be canceled.

 

10. International Orders

International buyers are responsible for:

  • Customs duties

  • Import taxes

  • Compliance with destination country laws

We are not liable for delays due to customs processing.

 

11. Limitation of Liability

You agree that ZESMACK is not liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of data, profits, or business

  • Delays or interruptions

  • Errors in product descriptions

  • Issues caused by misuse of items

Our total liability will not exceed:

The amount you paid us in the last 6 months OR ₹10,000 whichever is lower.

 

12. Indemnification

You agree to indemnify and hold harmless ZESMACK, employees, partners, and affiliates from any claims arising out of:

  • Misuse of the website

  • Violation of these Terms

  • Violation of any law or third-party rights

 

13. Governing Law & Jurisdiction

These Terms are governed by Indian law.

Any disputes will be handled exclusively in the courts of:

Surat, Gujarat, India

 

14. Dispute Resolution

Before legal action, you agree to attempt:

  1. Direct negotiation

  2. Mediation through a neutral third party

If unresolved, disputes will be settled via binding arbitration under the Arbitration & Conciliation Act, 1996.

Class-action lawsuits are not permitted.

 

15. Termination

We may suspend or terminate your account at any time for:

  • Violating these Terms

  • Fraudulent activity

  • Abuse of Services

You may close your account anytime by contacting us.

 

16. Miscellaneous

Entire Agreement

These Terms + Privacy Policy + Return Policy form the complete agreement.

Severability

If any part is invalid, the rest remains in effect.

Waiver

Failure to enforce a term does not mean we waive that right.

Force Majeure

We are not liable for delays due to events outside our control.

Assignment

You may not assign your rights; we may assign ours if needed.
